114FC.OH <br />ADMINISTRATIVE HEARING C.O.S. FRENCH CAMP LANDFILL 1/14/93 <br />An administrative Hearing for this site was conducted today. Participants were Phil <br />Giambiastiani and Rick Vidas of Gambie Enterprises, Phil Nisperos COS, John <br />Fukumoto COS, Mike Miller COS, Ed Padilla EHD, James Miller EHD and Steven <br />Sasson EHD. <br />1) Because the winter pad area in module 3 indicated on the winter plan dated <br />10/1/92 is currently unusable due to ponding and unsafe road conditions. A new <br />winter plan is to be submitted showing the new location in module 2. <br />2) The area of exposed waste shall be reduced to the maximum allowed by Aw= <br />6090 square feet by 1/28/93. If this does not occur then the operation will revert to <br />daily cover and will no longer be on performance standards. <br />3) Intermediate cover shall be placed over areas where buried waste is daylighting and <br />scraping of the intermediate cover to provide a source of soil to reduce the need for <br />imported soil material shall be discontinued. <br />4) The revised RDSI for the site has not yet been submitted to EHD. Without this <br />document the Solid Waste Facilities Permit may be revoked. Mike Miller stated that <br />there is a draft RDSI that needs to be finalized. <br />5) EHD wants a compliance agreement in 10 days by 1/25/92. A Compliance <br />agreement is essentially a work plan from the operator to the regulatory agency. <br />6) Cover material is to come from the pond. If a membrane is to be used for cover <br />indicate this in the compliance agreement. <br />7) At the end of one year we will evaluate the performance standards. At the end of <br />the next six months if violations continue, the landfill will be taken off performance <br />standards. <br />8) The CIWMB wants to revoke the permit in May of 94 which is 9 months prior to <br />completion of the grading plan. In the EHD meeting with the CIWMB a proposal <br />developed in which the grading violation could be reduced to an area of concern if <br />ponded areas are pumped dry. Once the grading violation is reduced to an area of <br />concern permit revocation is aborted for this violation. <br />9) In summary a compliance agreement is to be submitted to EHD by 1j/23/93 <br />addressing ponding, size of the active face, the updated RDSI, and scraping of <br />intermediate cover. <br />
