11 2EHD.WMB <br />MEETING WITH CIWMB <br />FACILITIES 1/12/93. <br />11 <br />On 1/12/93 a meeting with California Integrated Waste Management Board Staff and <br />EHD was conducted to discuss listing of the City of Stockton French Camp Landfill <br />on the list of non -complying facilities. Present at this meeting was Ed Padilla EHD, <br />James Miller EHD, Steven Sasson EHD, Brad Williams CIWMB, Mary Coyle CIWMB <br />and Mark D'Brie CIWMB. <br />The Board staff said that there are available minutes of the meeting between Board <br />staff and the Board where there was a change in the policy of listing facilities as non- <br />complying. There were four versions presented by Board staff and the Board chose <br />one. <br />EHD informed Board staff of the scheduled office hearing for French Camp Landfill. <br />Mark D'Brie suggested that the violation of CCR Section 17710 may be degraded to <br />an area of concern if ponding is addressed by pumping the storm water over the side <br />of the landfill into the sloughs. He suggested that as soon as the violation is changed <br />to an area of concern the listing permit revocation process is aborted. The <br />determination of whether or not the landfill is in compliance, an area of concern or a <br />violation will occur at the 90 day re -inspection <br />Board staff informed EHD that the Kiefer Road landfill in Sacramento will be a test <br />case before the Board sometime in February 1993. <br />There was some discussion of jurisdiction of the CIWMB vs. the jurisdiction of the <br />RWQCB. Mark D'Brie informed EHD that in a situation in which a CIWMB policy is <br />more stringent than that of the RWQCB that the more stringent policy is enforced. <br />
