• STATE WATER RESOURCES CONTROL ARD <br /> RESCLUTIO14 NO. 87- 22 <br /> POLICY ON THE DISPOSAL OF SHREDDER WASTE <br /> WHEREAS: <br /> 1. Chemical analysis of wastes resulting from the shredding of automobile <br /> bodies, household appliances, and sheet metal (hereinafter shredder <br /> waste) by methods stipulated by the Department of Health Services <br /> (hereinafter DHS) has resulted in the classification of shredder waste as <br /> a hazardous waste and the determination that, if inappropriately handled, <br /> it could catch fire and release toxic gases. <br /> 2. The California Legislature has declared that shredder waste shall not be <br /> classified as hazardous for the purposes of disposal if the producer <br /> demonstrates that the waste will not pose a threat to human health or <br /> water quality if disposed of in a qualified Class III waste management <br /> unit, as specified in Section 2533 of Subchapter 15 of Chapter 3 of <br /> Title 23 of the California Administrative Code (hereinafter <br /> Subchapter 15) . <br /> 3. DHS has granted shredder waste a variance for the purposes of disposal <br /> from hazardous waste management requirements pursuant to Section 66310 of <br /> Title 22 of the California Administrative Code. <br /> 4. Hazardous waste which has received a variance from DHS for the purposes <br /> of disposal is classified as a designated waste pursuant to Section 2522 <br /> of Subchapter 15. <br /> 5. In general, designated waste must be disposed of in a Class I or Class II <br /> waste management unit. However, designated waste may be disposed of in a <br /> Class III waste management unit provided that the discharger establishes <br /> to the satisfaction of the Regional Water Quality Control board <br /> (hereinafter Regional Board) that the waste presents a lower risk of <br /> degrading water quality than is indicated by its classification. <br /> (Authority: Section 2520, Subchapter 15) <br /> 6. Analysis of shredder waste by the U. S. Environmental Frotection Agency's <br /> extraction procedure for heavy metals does not normally result in its <br /> classification as a hazardous waste. <br /> 7. The disposal of shredder waste in a manner such that it is not in contact <br /> with putrescible waste or the leachate generated by putrescible waste <br /> will not result in the high mobilization of metals indicated by the tests <br /> used to determine that shredder waste is hazardous; therefore. such <br /> disposal may occur in accordance with Section 2520 of Subchapter 15. <br /> x• <br />
