-2- <br /> 8. Levels of polychlorinated biphenyls . (hereinafter PCB) which slightly <br /> exceed 50 mg/kgs the level as defined by the U. S. Environmental <br /> Protection Agency which requires disposal to an approved site in <br /> accordance with the Federal Toxic Substances Control Act. have been <br /> meas-fired in some existing shredder waste piles. <br /> THEREFORE BE IT RESOLVED: <br /> 1. That shredder waste which is determined hazardous by DHS, but is granted <br /> a variance for the purposes of disposal by DHS, is suitable for disposal <br /> at Class III waste management units as designat-ed_by_ the Regional Board <br /> when it has been demonstrated to the Regional Board that the waste <br /> management units at least meet the minimum requirements for a Class III <br /> waste management unit as defined by Subchapter 15 provided that: <br /> a. The shredder waste producer has demonstrated to the Regional Board <br /> that the waste contains no more than 50 mg/kg of PCB. <br /> b. The :shredder waste is disposed on the last and highest lift in a <br /> closed disposal cell or in an isolated cell solely designated for the <br /> disposal of shredder waste. <br /> 2. That shredder waste which is not determined hazardous by DHS is suitable <br /> for disposal at Class III waste management units as designated by the <br /> Regional Board without special segregation or management. <br /> 3. That this resolution in no way abridges the rights of the Regional Boards <br /> to designate appropriate Class III waste management units for disposal of <br /> shredder- waste consistent with Section 25143 .6 of the Health and Safety <br /> Code (Chapter 1395, Statutes of 1985) . <br /> CERTIFICATION <br /> %The undersigned, Administrative Assistant to the Board. does hereby certify <br /> that the foregoing is a full, true, and correct copy of a resolution duly and <br /> regularly adopted at a meeting of the State Water Resources Control Board held <br /> on March 19. 1987. <br /> i <br /> a een March <br /> Admi 'strative Assistant to the Board <br />
