Box 388
Waste Stockton, CA 95201-0388
Management
Board Subject: Enforcement Agency for the City of Stockton
8800 Cal Center Drive Dear Ms. Heran:a.
Sacramento, CA 95826
(916)155-2200 - The California Integrated} Waste Management Board (IWMB) has completed the review of the
resolution adopted by the City of Stockton (City) on June 10, 1996, withdrawing designation of
the San Joitquin County Public Health Services, Environmental Health Division, as the Local
Enforcement Agency (LEA) for the City.
IWMB staff have determined that the City may withdraw its designation pursuant to Public
Resources Code (PRC) Sections 43203 and 43206 and California Code of Regulations (CCR),
Title 14, Section 18056. The effective date of the withdrawal of designation is September 8,
1996. If no enforcement agency is designated in 30 days from September 8, 1996, the IWMB
will become the enforcement agency for the City effective October 8, 1996.
The IWMB staff find that the withdrawal of designation was a determination by the City and
should not be a reflection on the LEA's fulfillment of its duties and responsibilities.
The IWMB staff, effective September 8, 1996, will be inspecting facilities in the City jurisdiction
to protect the public health and safety and the environment. If no enforcement agency is
designated, effective October 8, 1996, the IWMB will become the solid waste enforcement agency
for permitting, inspection, and enforcement duties for the City of Stockton.
Please do not hesitate to call me at (916) 255-2298 or Ms. Mary T. Coyle at (916) 255-3849 if we
may be of assistance or if there are any questions.
Sincerely,
H.
