The Discharger is regulated under Cleanup and Abatement Order No. R5- <br />2006-0707 and Waste Discharge Requirements Order No. R5-2007-0084 (WDRs) for closure <br />and post closure maintenance and -monitoring of an auto shredder waste landfill. <br />During this site visit, staff observed that the Discharger has violated conditions and <br />requirements of the WDRs. The Discharger violated Sections CA, C.5, C.6, and EA of the <br />WDRs, including failure to identify and repair problem areas; failure to irrigate and maintain <br />vegetation; failure to repair and stop erosion damage; and failure to control stormwater <br />drainage. In this regard, the top and side slopes of the landfill cover have little to no <br />vegetation; rills and gullies are deep and extensive along the western side slope; and rills are <br />numerous along the southern side slope. One gully has eroded down to the low hydraulic <br />conductivity layer (i.e., the clay layer). The cover top, the eastern side slope, and southern <br />side slope are bare earth with no vegetation. <br />Therefore, based on these violations, the Discharger shall begin mitigation measures as listed <br />below: <br />1. Forthwith and before the next storm event, the Discharger shall install erosion <br />control measures to prevent further erosion and damage to the top and side slopes of <br />the cover. By 29 February 2008, the Discharger shall submit a report that documents <br />the erosion control measures that have been implemented. As required by the WDRs, <br />the report must be signed and stamped by a California registered geologist or civil <br />engineer. The Discharger's certification statement shall be included in the report. <br />2. By 15 March 2008, the Discharger shall submit a construction quality assurance plan, <br />schedule, and work plan that shall include measures to repair the damage to the landfill <br />cover.
