WEAVER COMPOSTING <br />FACILITY, USE PERMIT & SITE PLAN, 2403 W. <br />LOUISE AVENUE, HAROLD ROUSE <br />This item was continued from the October 29 <br />meeting in order that the applicant could be <br />present to respond to Commissioner questions. <br />The Commission expressed concern regarding dust <br />affecting the neighboring residents. <br />Planning staff also met with the applicant to <br />review the list of planning related conditions. <br />Mr. Tim Weaver, the applicant, is of the opinion <br />that since the use was established in the County <br />and the proposed greenwaste composting operation <br />is a separate use, new conditions should not. be <br />imposed on Weaver Industries. Staff pointed out <br />that the composting operation proposed by <br />Biorecycling Technologies, Inc. (BTI) is <br />occupying the same property as Weaver Industries, <br />and is sharing most of the same facilities for <br />grinding, bagging, warehousing, access, etc. <br />There is an overlap of facility utilization to <br />such an extent that it would be impossible for <br />separate condi-tions-to be developed.. <br />Staff also noted that while the original permit <br />approvals were secured from the County, complete <br />compliance with County conditions has not <br />occurred to date, thus a legal nonconforming <br />status has not been vested. It is the City's <br />intent to ensure that the County's conditions are <br />satisfactorily completed based on the original <br />use permit. New conditions imposed at this time <br />are in response to the subject request to expand <br />the use of the property to include greenwaste <br />composting. <br />In a spirit of cooperation, staff is suggesting <br />that the applicant be allowed a six month period <br />to complete the condi-tions, including the <br />remaining County conditions imposed on August 17, <br />1995. <br />Staff's original recommended course of action <br />remains unchanged, except for the fire <br />department's memo of October 22, 1996. <br />Applicant: Weaver Industries, Inc., 1380 N.
