Dwane Milnes <br />September 6, 1995 <br />Page 2 <br />"...should the owner/operator of this facility wish to expand the operation <br />to allow the recycling/transfer of other solid wastes, not presently <br />covered by the existing Use Permit, an application for a rezoning from M- <br />1, Light Industrial District, to M-2, Heavy Industrial District, and a Use <br />Permit must be submitted and approved. Those discretionary <br />applications would be subject to CEQA and would, therefore, require the <br />processing of, at minimum, an Initial Study. The rezoning to M-2 would <br />be required pursuant to a recent amendment to our Zoning Code <br />(effective February 23, 1994). A copy of the applicable ordinance is <br />attached." <br />Mr. Robert Ronyak 11, the owner/operator of the subject facility, was also contacted <br />by telephone regarding this matter and informed of the rezoning and Use Permit <br />requirements. However, to date, the required applications have not been filed. Mr. <br />Ronyak noted that he annually pays business license fees for a "junk dealer's license" <br />and assumed that said license allowed his current operation. However, he was <br />informed that said license did not allow activities which were not allowed by the <br />current Use Permit.
