Solid waste: fertilizingmaterials. <br /> (1) Existing law regulates the manufacture, labeling, and <br /> distribution of agricultural products derived from municipal sewage <br /> sludge as fertilizer material,and exempts these products,when used <br /> in general commerce,from regulation as a hazardous substance and <br /> as a waste under designated provisions. <br /> This bill would provide for the exemption of these agricultural <br /> products from regulation as a solid waste under other designated <br /> provisions, and make a related legislative declaration. <br /> (2) Existing law prohibits the establishment of new solid waste <br /> transfer or processing stations or disposal sites, with specified <br /> exceptions. <br /> The bill would enact similar provisions,including the provisions in <br /> the bill, into the Public Resources Code, to be operative only if AB <br /> 939 is enacted. <br /> The people of the State of California do enact as follows: <br /> SECTION 1. The Legislature hereby declares that the purpose of <br /> this act is as follows: <br /> (a) To encourage recycling of sewage sludge for use as a fertilizer <br /> material. <br /> (b) To encourage reduction of the amount of sewage sludge that <br /> is disposed of in municipal landfills. <br /> (c) To make available to the agricultural industry additional <br /> fertilizer materials. <br /> (d) To assure that facilities which produce fertilizer material <br /> derived from municipal sewage sludge are in compliance with all <br /> applicable requirements which are intended to protect public health <br /> and the environment, including any relevant waste discharge <br /> requirements imposed by a California regional water quality control <br /> board and local health departments. <br /> (e) To assure that sites where the fertilizer material derived from <br /> municipal sewage sludge is applied as a fertilizer material are in <br /> compliance with all applicable requirements which are intended to <br /> protect public health and the environment,including any relevant <br />
