Ch. 1247 — <br /> waste discharge requirements imposed by a California regional <br /> water quality control board and local health departments. <br /> (f) To assure that applications of fertilizer material derived from <br /> municipal sewage sludge be made at rates that protect public health, <br /> the environment, benefit the soil, and do not merely constitute <br /> disposal. <br /> SEC.2. Section 66784.4 of the Government Code is amended to <br /> read: <br /> 66784.4. (a) The board may,by regulation,specify classifications <br /> of solid waste facilities that shall be exempt from the requirements <br /> of Sections 66783.1 and 66784. Any regulation may be adopted only <br /> if the board makes all of the following findings: <br /> (1) The exemption is not contrary to the public interest. <br /> (2) The quantity of solid wastes to be disposed of at each site is <br /> insignificant. <br /> (3) The nature of the solid wastes poses no significant threat to the <br /> public health, the.public safety, or the environment. <br /> (b) The application to land of agricultural products derived from <br /> municipal sewage sludge for use as a fertilizer material shall, based <br /> on a finding by the board that the nature of the solid waste poses no <br /> significant threat to the public health, the public safety, or the <br /> environment,be exempt from the requirements of Sections 66783.1 <br /> and 66784. <br /> SEC.3. Division 31 (commencing with Section 5 ) is added to <br /> the Public Resources Code, to read: <br /> DIVISION 31. WASTE MANAGEMENT FACILITIES <br /> 50000. (a) Until a countywide integrated waste management <br /> plan of a 'county has been approved by the California Integrated <br /> Waste Management Board pursuant to Division 30 (commencing <br /> with Section 40000),no new transfer or processing station or disposal <br /> sites approved by a city or county after January 1, 1978, shall be <br /> established in a city or county without a finding by the board, at a <br /> public meeting, that the protection of the public health, or public <br /> need and necessity, require the immediate implementation of the <br /> sites. <br /> (b) Any site is exempt from this requirement if, prior to August <br /> 28, 1974, there is an environmental impact report notice of <br /> determination filed with the state or if a use permit or approval has <br /> been issued for the site by the city or county. <br /> 50001. No person shall establish sites for solid waste disposal, a <br /> transfer station, waste processing, or resource recovery not in <br /> conformance with the countywide integrated waste management <br /> plan approved by, the California Integrated Waste Management <br /> Board.
