Box 5104 <br /> Stockton,Ca 95205 <br /> RE: Illegal dumping of solid waste at Wimer Road Ranch, Unden, Ca <br /> San Joaquin County, Public Health Services-Environmental Health Division (PNS-EHD)conducted a <br /> complaint investigation on July 12,1999,at the above referenced location. The complaint alleged illegal <br /> dumping of solid waste at this location. The Public Resources Code(PRC)Division 30,Part 1, Chapter 2, <br /> Section 40191(a)includes"demolition and constructs wastes",as part of the definition of solid waste. <br /> The PRC further defines disposal as a final deposition of solid wastes onto land, into the atmosphere, or <br /> into the waders of the to". The results of the investigationconfirmed the presence of concrete,steel, ale, <br /> small amounts of wood, soil,and bricks deposited the ground along east Side of Indian Creek. This <br /> activity is in violation of the following Codes and County Ordinances: <br /> L. (PRC),Section 44002(a)(1). <br /> 2_ San Joaquin County Ordinance(S)CO),No,Z087,Chapter 4,Section 5-2400: <br /> Accumulation of refuse,waste, and filth prohibited. <br /> 3. SJCO,Chapter 4, Section 5-2401-, s ai on premMs. <br /> 4. SJCO,Chapter 6, Section 5-2600: Disposal area permit required. <br /> S. SJCO,ChapW 6, Section 5-2302: Building Ma als. <br /> According to the PRC, sections 45000,45005,and 45'011,this d' ision has the authoft to: issue an <br /> admiriPstmtive order requiring the owner or operator of a solid waste facility to take corrective action as <br /> necessary to abate a nuisance,cease and desist any improper action,and establish a time schedule <br /> according to which the facility shall be brought Into compliance. <br /> Effective immediately cease and desist all unauthorized disposal of solid waste onto the above referenced <br /> location.
