The voting on resolutions and motions shall be by roll call, <br /> and the ayes and noes, members present, and those not voting shall be entered upon <br /> the minutes of the meeting. <br /> IV.APPEALS TO PANEL <br /> A. WHO MAYAPPEAL. Any person affected by any action taken may appeal any San <br /> Joaquin County—Environmental Health Division(SJC—EHD) action or decision of <br /> the Public Health Services Hearing_ Panel by filing a written appeal at the SJC—EHD <br /> office. <br /> B. PROCESSING OFAPPEALS. Receipt of any appeal shall be no more than 20 days <br /> from the date of the appeal as filed with the SJC-EHD. Written notice of the time and <br /> place of the appeal hearing shall be given to each appellant by SJC-EHD prior to the <br /> date of the public hearing. <br /> C. CONTINUANCE OF HEARING. There may be a continuance of hearing due to <br /> new information and evidence provided. <br /> D. EFFECT OF FAILURE TO APPEAL. Failure of any person to file an appeal in <br /> accordance with the provisions stated above shall constitute a waiver of the right to a <br /> hearing and adjudication of the notice and order or to any portion thereof. <br /> E. SCOPE OF HEARING ONAPPEAL. Only those matters or issues specifically <br /> raised by the appellant shall be considered in the hearing of the appeal. <br /> F. STAYING OF ORDER UNDER APPEAL. Except for order to vacate and/or <br /> emergency abatement, enforcement of any notice and order of the enforcement <br /> agency official issued under this code shall be stayed during the pendency of an <br /> appeal involving Solid Waste Exemption Permits therefrom which is properly and <br /> timely filed. <br /> Page 2 of 2 June 18,2001 <br />
