I doing business in the State of California and confined to Defendant's GASOLINE STATION 2 activities in the County of San Joaquin and elsewhere in the State of California. 3 3. Defendant,with actual or constructive knowledge of this Injunction, only in so far as they 4 are doing business in the State of California,in the course of Defendant's GASOLINE STATIONS 5 activities, are pursuant to Health and Safety Code section 25299.01 are permanently enjoined from: 6 a. Failing to equip underground storage tanks with a spill container and an overfill 7 prevention system that does not allow manual override,in violation of California Code of 8 Regulations,title 23 section 2635(b)(2); 9 b. Failing to perform annual monitoring certification and leak detector testing,in 10 violation of California Code of Regulations,title 23 section 2638(a); 1 I c. Failing to construct, operate, or maintain a secondary containment to prevent any 12 water intrusion into the system by precipitation, infiltration,or surface runoff, in violation of Health 13 and Safety Code section 25290.I(c)(3); 14 d. Failing to maintain a monitoring system for water intrusion and for removing the 15 water, in violation of Health and Safety Code section 25291(e); 16 e. Failing to annually perform an automatic line leak detector tightness test, in 17 violation of Health and Safety Code section 25291(£); 18 f. Failing to maintain evidence of financial responsibility, in violation of Health and 19 Safety Code section 25292.2(a); 20 g. Failing to annually test the spill containment structure,in violation of Health and 21 Safety Code section 25284.2; 22 h. Failing to install automatic line leak detectors on underground pressurized piping 23 capable of detecting 3-gallon per hour leak rate at 10 psi, in violation of California Code of 24 Regulations,title 23 section 2636(f)(2); 25 i. Failing to submit a copy of the secondary containment test report to the local 26 agency within thirty(30) days of the completion of the test; in violation of California Code of 27 Regulations,title 23 section 2637(e); 28 j. Failing to submit a completed Monitoring System Certification form to the local -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION I
