1 requirements,in violation of California Code of Regulations,title 23 section 2661. <br /> 2 4. Defendant,with actual or constructive knowledge of this Injunction,only in so far as they <br /> 3 are doing business in the State of California,in the course of Defendant's GAS STATION activities, <br /> 4 are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br /> 5 a. Treating, storing, disposing of or offered to transport hazardous waste without an <br /> 6 Identification Number, in violation of California Code of Regulations,title 22 section 66262.12(a); <br /> 7 b. Failing to completely label or mark each container or portable tank used for onsite <br /> 8 accumulation of hazardous waste, in violation of California Code of Regulations, title 22 section <br /> 9 66262.34(f); <br /> 10 c. Failing to post emergency coordinator information next to the telephone,in <br /> 11 violation of California Code of Regulations section 66262.34(d)(2); <br /> 12 d. Disposing of, or attempting to dispose of liquid latex paint in the land or into the <br /> 13 waters of the state, in violation of Health and Safety Code section 25217.1; <br /> 14 e. Storing hazardous waste onsite longer than one hundred eighty(180)days, in <br /> 15 violation of California Code of Regulations,title 22 section 66262.34(d); <br /> 16 f. Failing to label or mark containers used for onsite accumulation of hazardous <br /> 17 waste, in violation of California Code of Regulations,title 22 section 66262.34(f); <br /> 18 g. Failing to maintain and operate facility to minimize the possibility of fire, <br /> 19 explosion, or any unplanned sudden or non-sudden release of hazardous waste, in violation of <br /> 20 California Code of Regulations,title 22 section 66265.31; and <br /> 21 h. Failing to keep container holding hazardous waste closed during transfer and <br /> 22 storage, except when it is necessary to add or remove waste, in violation of California Code of <br /> 23 Regulations,title 22 section 66265.172(a). <br /> 24 5. Defendants, in the course of Defendants' gasoline sales activities, are pursuant to Health <br /> 25 and Safety Code section 25500 et seq.,hereby permanently enjoined from: <br /> 26 a. Violating Health and Safety Code section 25503.5(a),being a business that handles <br /> 27 a hazardous material or a mixture containing a hazardous material that has a quantity at any one time <br /> 28 during the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of <br /> -5- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
