1 55 gallons,or 200 cubic feet at standard temperature and pressure for compressed gas, including but <br /> 2 not limited to DIESEL, GASOLINE,AND PRESOAK DETERGENT,failing to establish and <br /> 3 implement a business plan for emergency response to a release or threatened release of a hazardous <br /> 4 material for 717 W. 8TH STREET, STOCKTON, CALIFORNIA in violation of Health and Safety <br /> 5 Code section 25503.5(a); <br /> 6 b.Violating Health and Safety Code section 25504(b),business plan failing to include <br /> 7 emergency response plans and procedures in the event of a reportable release or threatened release of <br /> 8 a hazardous material,including but not limited to the following: <br /> 9 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 10 Services and to the appropriate local emergency rescue personnel; <br /> 11 2. Procedures for the mitigation of a release or threatened release to minimize <br /> 12 any potential harm or damage to persons,property, or the environment; <br /> 13 3. Evacuation plans and procedures,including immediate notice,for the <br /> 14 business site; <br /> 15 c. Violating Health and Safety Code section 25504(c), failing to provide training for <br /> 16 all new employees and annual training, including refresher courses, for all employees in safety <br /> 17 procedures in the event of a release or threatened release of a hazardous material, including, but not <br /> 18 limited to,familiarity with the plans and procedures specified in Health and Safety Code section <br /> 19 25504(b); <br /> 20 d. Violating Health and Safety Code section 25505,failing to submit a business plan <br /> 21 for emergency response to a release or threatened release of hazardous material within four(4)years <br /> 22 prior to the filing of this complaint for 717 W. 8TH STREET, STOCKTON, CALIFORNIA,to the <br /> 23 San Joaquin County Office of Emergency Services. Further, it is alleged that said violation was <br /> 24 knowingly committed after reasonable notice; <br /> 25 e. Violating Health and Safety Code section 25505(e)(2),failing to annually submit a <br /> 26 form,provided by the San Joaquin County Office of Emergency Services,that certifies that the <br /> 27 handler has included, and maintains as current, in the business plan,all other information required by <br /> 28 Health and Safety section 25504; <br /> -6— <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
