I 6. Defendants,in the course of Defendants' GASOLINE SALES ACTIVITIES,are pursuant <br /> 2 to Fish and Game section 5650(a)(1),hereby permanently enjoined from: <br /> 3 a. Violating Fish and Game Code,section 5650(a)(1),depositing in,permitting to <br /> 4 pass onto, or placing where it can pass into the waters of this state,including but not limited to <br /> 5 diesel and/or gasoline. <br /> 6 7. Defendant with actual or constructive knowledge of this Injunction,only in so far as they <br /> 7 are doing business in the State of California, in the course of Defendant's GAS STATION activities, <br /> 8 are, pursuant to California Business and Professions Code section 17204,hereby permanently <br /> 9 enjoined from: <br /> 10 a. Violating Health and Safety Code section 25280 et seq., described in paragraph <br /> 11 3—3dd above; <br /> 12 b. Violating Health and Safety Code section 25100 et seq.,described in paragraph <br /> 13 4—4h above; <br /> 14 c. Violating Health and Safety Code section 25500 et seq.,as described in paragraph <br /> 15 5-5j above;and <br /> 16 d. Violating Fish and Game Code, sections 5650 et seq.,as described in paragraph 6— <br /> 17 6a above. <br /> 18 8. Defendants shall pay to Plaintiff the sum of TEN THOUSAND DOLLARS ($10,000.00), <br /> 19 as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment shall be made <br /> 20 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT— <br /> 21 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br /> 22 Joaquin County Office of the District Attorney,at time of signing. <br /> 23 9. Defendants shall pay to Plaintiff the sum of TEN THOUSAND DOLLARS ($10,000.00), <br /> 24 as and for civil penalties, pursuant to Business and Professions Code section 17206. Said payment <br /> 25 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 26 Joaquin County Office of the District Attorney,Environmental Crimes Unit,at time of signing. <br /> 27 10. Defendant shall be penalized, as and for civil penalties,pursuant to Business and <br /> 28 Professions Code sections 17200 et seq.,in addition to those civil penalties set forth in paragraphs 8 <br /> -8- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br /> I <br />
