I 6. Defendants,in the course of Defendants' GASOLINE SALES ACTIVITIES,are pursuant 2 to Fish and Game section 5650(a)(1),hereby permanently enjoined from: 3 a. Violating Fish and Game Code,section 5650(a)(1),depositing in,permitting to 4 pass onto, or placing where it can pass into the waters of this state,including but not limited to 5 diesel and/or gasoline. 6 7. Defendant with actual or constructive knowledge of this Injunction,only in so far as they 7 are doing business in the State of California, in the course of Defendant's GAS STATION activities, 8 are, pursuant to California Business and Professions Code section 17204,hereby permanently 9 enjoined from: 10 a. Violating Health and Safety Code section 25280 et seq., described in paragraph 11 3—3dd above; 12 b. Violating Health and Safety Code section 25100 et seq.,described in paragraph 13 4—4h above; 14 c. Violating Health and Safety Code section 25500 et seq.,as described in paragraph 15 5-5j above;and 16 d. Violating Fish and Game Code, sections 5650 et seq.,as described in paragraph 6— 17 6a above. 18 8. Defendants shall pay to Plaintiff the sum of TEN THOUSAND DOLLARS ($10,000.00), 19 as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment shall be made 20 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT— 21 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San 22 Joaquin County Office of the District Attorney,at time of signing. 23 9. Defendants shall pay to Plaintiff the sum of TEN THOUSAND DOLLARS ($10,000.00), 24 as and for civil penalties, pursuant to Business and Professions Code section 17206. Said payment 25 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San 26 Joaquin County Office of the District Attorney,Environmental Crimes Unit,at time of signing. 27 10. Defendant shall be penalized, as and for civil penalties,pursuant to Business and 28 Professions Code sections 17200 et seq.,in addition to those civil penalties set forth in paragraphs 8 -8- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION I
