I f. Violating Health and Safety Code section 25503.5(a),being a business that handles <br /> 2 a hazardous material or a mixture containing a hazardous material that has a quantity at any one time <br /> 3 during the reporting year equal to, or greater than, a total weight of 500 pounds,or a total volume of <br /> 4 55 gallons,or 200 cubic feet at standard temperature and pressure for compressed gas, including but <br /> 5 not limited to diesel and/or gasoline failed to establish and implement a business plan for emergency <br /> 6 response to a release or threatened release of a hazardous material for 717 W. 8th St., Stockton, <br /> 7 California; <br /> 8 g. Violating Health and Safety Code section 25504(b), failing to have a business plan, <br /> 9 which includes emergency response plans and procedures in the event of a reportable release or <br /> 10 threatened release of a hazardous material,including but not limited to the following: <br /> 11 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 112 Services and to the appropriate local emergency rescue personnel; <br /> 13 2. Procedures for the mitigation of a release or threatened release to minimize <br /> 14 any potential harm or damage to persons, property, or the environment; <br /> 15 3. Evacuation plans and procedures, including immediate notice, for the <br /> 16 business site; <br /> 17 h. Violating Health and Safety Code section 25504(c), failing to train all new <br /> 18 employees and annual training,including refresher courses,for all employees in safety procedures in <br /> 19 the event of a release or threatened release of a hazardous material, including, but not limited to, <br /> 20 familiarity with the plans and procedures specified in Health and Safety Code section 25504(b); <br /> 21 i. Violating Health and Safety Code section 25505,failing to submit a business plan <br /> 22 for emergency response to a release or threatened release of hazardous material for the year 2007 for <br /> 23 717 W. 8th St., Stockton, California to the San Joaquin County Office of Emergency Services. <br /> 24 Further,it is alleged that said violation was knowingly committed after reasonable notice; and <br /> 25 j. Violating Health and Safety Code section 25505(e)(2), failing to annually submit a <br /> 26 form,provided by the San Joaquin County Office of Emergency Services,that certifies that the <br /> 27 handler has included,and maintains as current, in the business plan, all other information required by <br /> 28 Health and Safety section 25504. <br /> -7- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
