Pacific Ethanol, Inc. <br /> 25250.12 under Article 13 of Management of Used Oil: -The amount of used oil <br /> generated showing that no more than 55 gallons is transferred in the vehicle at any one <br /> time. -The address information on where used oil is being transported to. -The date the <br /> used oil is generated. Per Title 22 California Code of Regulations (CCR) 66266.130, oil <br /> filters that are not completely drained need to be managed as hazardous waste. If the oil <br /> filters are not going to be drained, immediately start to dispose of them properly <br /> according to hazardous waste rules and regulations. Hazardous waste generators shall <br /> retain copies of all manifests signed off by the disposal facility and all receipts used in a <br /> consolidated manifesting procedure on site for three years and have them readily <br /> available for review. Immediately locate a copy of all manifests and receipts for the last <br /> three years and maintain them on site. In addition, start to maintain all required records. <br /> PES Response: Please see Item 9110 above and Appendix F and G that addresses the <br /> resolution to this violation. <br /> Item # 304 CCR 66262.34(d)(2) Failed to maintain adequate aisle space for <br /> unobstructed response to emergencies: One 55 gallon drum containing used oil and <br /> one 55 gallon drum containing oily debris are being stored in a covered secondary <br /> containment. The covered secondary containment was blocked by a 275 gallon used oil <br /> tank. Adequate aisle space shall be maintained to allow the unobstructed movement of <br /> personnel, fire protection, spill control equipment, and decontamination equipment to all <br /> areas of facility operation in an emergency. Immediately maintain aisle space to allow the <br /> unobstructed movement of personnel, fire protection, spill control equipment, and <br /> decontamination equipment to any area of facility operation in an emergency. <br /> PES Response: Please see photo # 3 in Appendix B showing the tank has been moved to <br /> allow proper access to the storage containers. <br /> Item # 406 CCR 66261.7 Contaminated container not marked with date emptied or <br /> managed within one year of being emptied: Near the used oil storage area, 15 purple <br /> and 3 black 55 gallon drums were observed without an empty date. In addition, there <br /> were empty 55 gallon drums and 275 gallon totes observed throughout the facility <br /> without an empty date. Containers larger than five gallons that previously held a <br /> hazardous material shall be marked with the date they were emptied and managed within <br /> one year of being emptied.
