OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM) 003732573GBF from 5/30/18 and 003371481GBF from 3/20/17. REGULATION GUIDANCE: (a) A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c)A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest, with some indication that the generator has not received confirmation of delivery. (d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 days. This is a Class II violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. OBSERVATION: A 6ft by 3 ft area of sandy absorbent was observed on the asphalt surface of the gasoline and diesel fueling station. Oil soaked sandy absorbent was observed on the asphalt on the north east side of the shop. One 5 gallon bucket containing oil draining from an oil drain pan was observed in the hazardous waste storage area and another 5 gallon bucket containing a clear yellow fluid was observed in the main shop, both open and without labels. REGULATION GUIDANCE: A hazardous waste generator must maintain and operate its facility to minimize the possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water which could threaten human health or the environment. CORRECTIVE ACTION: Immediately clean up the spills covered in absorbent material and ensure hazardous waste contained in the 5 gallon buckets are managed by the end of the day. Manage the waste according to Title 22 California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up waste.
