Facility personnel stated the metal <br /> fines are from carbon steel and are disposed of in the regular garbage. <br /> REGULATION: Any person who generates a waste shall determine if the waste is a hazardous waste as specified <br /> in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are <br /> wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. Metal <br /> particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if the metal is <br /> determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as scrap <br /> metal. <br /> CORRECTIVE ACTION: Immediately stop disposal of the metal fines into regular trash pick-up, make a hazardous <br /> waste determination for the waste, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste <br /> sampling and test results or other knowledge to make your hazardous waste determination. Waste testing must be <br /> done using methods specified in Title 22 CCR including Title 22 CCR sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a minor violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> The spill pallet for the used oil and oil product tanks was observed with an accumulation of oily liquid. Facility <br /> personnel stated the spill pallet is drained out when the hauler does waste pick up. Staining was observed on the <br /> ground in the area surrounding the fuel disposal nozzle for the diesel tank. Several spills were observed inside the <br /> main shop and out side the main shop that were covered in absorbent sandy material. Facilities shall be maintained <br /> and operated to minimize the possibility of a fire, explosion,or release of hazardous waste to air, soil, or surface <br /> water which could threaten human health or the environment. Immediately remove the accumulation of oily liquid <br /> from the spill pallet, clean up the staining around the fuel tanks, and clean up the spills inside and outside of the shop, <br /> and manage according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation <br /> explaining how this waste was managed. <br /> This is a minor violation. <br /> 601 CCR 66262.34(d)Stored hazardous waste onsite greater than 180 days. <br /> The last pick up for used oil was on 1/26/18 and there was no accumulation start date on the tank. Facilities who <br /> generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at <br /> any time may store waste on site up to 180 days.
