Safety Code and its implementing regulations in the CaliNnia Code of <br />Regulations, title 22, including, but not limited to, section 66262.34, <br />4..3.s. Failing to comply with the Medical Waste Management Act, Health and <br />Safety Code section 117600 et seq. <br />4.4L Unexpected Hazardous Waste and/or Medical Wade. <br />CLS shall include in each future contract and contract renewal with a <br />Reverse Logistics client (retail dlient nd manuPacturer clients), a provision thatprohibits that <br />client from shipping, or causing to be shipped, any item that is broken, leaking or inSome <br />other way damaged such that it cannot be used for its intended purposes, and is a hazardous <br />waste, or an over-the-counter non-preseription pharmaceutical that has expired and cannot he <br />lawfully sold, and is a hazardous wasiO or a medical waste, to any Enjoined Facility except us <br />allowed by Jaw, <br />41.4.b, ID the event, any item received by Defendant is a hazardous waste or a <br />medieal waste at the time it is received, Defendant shall take steps to properly manage any such <br /> <br />9 <br /> <br />STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
