it <br />X. UNDERGROUND TANKS. <br />di s after the execution of this <br />A. Prior to or within twenty (20) days <br />Lease, LESSEE shall be entitled to pressure test the'.lintegrity of the <br />i <br />underground storage tanks and related piping, if any., and to drill such <br />monitoring wells as LESSEE may in its discretion fine necessary. In the event <br />i <br />r the underground tanks and piping are leaking or� are not product tight or in <br />the event the soil or underground water conditions as shown by the monitoring <br />wells are contaminated or are not acceptable to LESSEE, LESSEE may cancel this <br />Lease forthwith without liability or penalty. 11 <br />B. LESSEE shall undertake appropriate inventory controls and <br />reconciliations so as to detect as soon as possllible{any underground leaks. <br />4 <br />Any such leaks shall be promptly reported to LISSOR!f However, LESSEE shall <br />! not be responsible for any cost or damages resu�lting�from any Leaks from the <br />10 !! underground facilities nor shall LESSEE be responsible for any repairs to the <br />underground facilities, except that LESSEE shal`1 pay the first five hundred <br />dollars ($SOO.QO) for any such repairs. <br />1 ' <br />I <br />� F <br />XI. DESTRUCTION. <br />A. In the event the Premises are entirely or partially damaged or <br />destroyed, the parties agree to use the proceeds o0 any insurance coverage or <br />f i <br />r other recovery to rebuild the Premises. Neither party shall be obligated to <br />i undertake additional expense to rebuild the Premises. <br />B. In the event the rebuilt Premises are less than the Premises <br />existing prior to the damage or destruction, LESSEEIshall have the option to <br />k <br />terminate the Lease without penalty or accept .a reduction in the rent for the <br />Premises.
