REQUEST FOR SITE CLOSURE REPORT <br />Former Beacon Station #610 <br />103300 Waterloo Road, Stockton, California <br />AMV Project No 19042 04 <br />In <br />up or abating the effects of, a discharge of a hazardous substance which creates, or threatens to <br />create, a condition of contamination, pollution, or nuisance " The terms contamination, <br />pollution, and nuisance are defined in Section 13050 of the Porter -Cologne Water Quality <br />Control Act as follows: <br />(k) "Contamination" means an impairment of the quality of waters of the state by <br />waste to a degree which creates a hazard to the public health through poisoning or <br />through the spread of disease "Contamination" includes any equivalent effect <br />resulting from the disposal of waste, whether or not the waters of the state are <br />affected. <br />(1) "Pollution" means an alteration of the quality of the waters of the state by waste <br />to a degree which unreasonably affects either of the following <br />(1) The waters for beneficial uses <br />(2) Facilities which serve these beneficial uses <br />"Pollution" may include "contamination " <br />(m) "Nuisance" means anything which meets all of the following requirements: <br />(1) Is injurious to health, or is indecent or offensive to the senses, or an <br />obstruction to free use of property, so as to interfere with the comfortable <br />enjoyment of life and property <br />(2) Affects at the same time an entire community or neighborhood, or any <br />considerable number of persons, although the extent of the annoyance or <br />damage inflicted upon individuals may be unequal <br />(3) Occurs during or as a result of the treatment or disposal of wastes <br />Section 13241 of the Porter -Cologne Water Quality Control Act explicitly recognizes that "it <br />may be possible for the quality of water to be changed to some degree without unreasonably <br />affecting beneficial uses " This section continues <br />Factors to be considered by a regional board in establishing water quality objectives shall <br />include, but not necessarily be limited to, all of the following <br />(a) Past, present, and probable future beneficial uses of water <br />(b) Environmental characteristics of the hydrographic unit under consideration, <br />including the quality of water available thereto <br />(c) Water quality conditions that could reasonable be achieved through the coordinated <br />control of all factors which affect water quality in the area. <br />(d) Economic considerations <br />Based on an evaluation of the present and historic soil and ground water conditions at the subject <br />property, we do not believe that further investigative or remedial action is warranted at this site, <br />and we do not believe that such actions are required by regulation It is clear that the conditions <br />rptl14 m1 <br />BQ011528 <br />
