REQUEST FOR SITE CLOSURE REPORT <br />Former Beacon Station /610 <br />3300 Waterloo Road, Stockton, California <br />AMV Protect No 19042.04 <br />in <br />of "contamination," "pollution," or "nuisance" as defined by regulations authorizing the state <br />to mandate action do not currently exist, and may never have existed, at this site There is no <br />compelling data that suggests that the beneficial use of ground water in the area of the site has <br />been unreasonably affected. <br />Under Section 13267 of the Porter -Cologne Water Quality Control Act, regional boards (and <br />their representatives) are authorized to require that any entity discharging waste within its region <br />(or outside of its region that could affect water quality within its region) prepare technical <br />reports as specified by the regional board However, Section 13267 limits this authority as <br />follows <br />The burden, including costs, of these reports shall bear a reasonable relationship to the <br />need for the report and the benefits to be obtained from the reports <br />Reports previously prepared for this site and this report indicate that neither "contamination," <br />"pollution," nor "nuisance" exist at this site Since these conditions do not exist, preparation <br />of a corrective action plan as requested in your correspondence to Ultramar received on <br />+ December 28, 1994, represents a burden to Ultramar without proportional benefit <br />For the following reasons, AMV believes this site should be closed <br />• 286 pounds of petroleum constituents as gasoline and 2,464 pounds of petroleum <br />constituents as diesel have been removed by active remediation (excavation) at the <br />site These totals represent approximately 85 percent of the total mass of <br />petroleum hydrocarbon constituents initially present in soil beneath the site <br />• Ground water beneath the site does not presently contain petroleum hydrocarbon <br />constituents and petroleum constituents have not been detected in ground water <br />samples collected from the site since April of 1993 <br />• Only single digit part -per -billion range concentrations of benzene, toluene, <br />ethylbenzene, and xylenes have ever been detected in ground water samples <br />collected from monitoring wells at the site <br />• Neither "contamination," "pollution," nor "nuisance" as defined by the California <br />Water Code currently exist at the site <br />cpil14 ml <br />BQ011529 <br />
