MODIFIED CONDITIONS OF APPROVAL <br /> 1 . The permitted uses shall not , at any time , develop into a <br /> nuisance , as herein defined. If , in the opinion of the <br /> Planning Commission or Board of Supervisors , any County <br /> Ordinance or State Law or regulations or conditions attached <br /> hereto are being violated in connection with the operation of <br /> this use , they retain the power to revoke or modify this per- <br /> mit . For the purposes of this Use Permit , a nuisance is <br /> defined as follows : <br /> "Nuisance is defined as anything resulting from unreason- <br /> able or unlawful practices or from neglect which is , or <br /> tends to be , injurious to health, safety, or public <br /> welfare , or is unsightly or offensive to the senses so <br /> as to interfere with the comfortable enjoyment of life <br /> or property in the neighborhood area, as such neigh- <br /> borhood area is defined by the Planning Commission. " <br /> 2 . A revised site plan shall be submitted for approval to the <br /> Planning Division by April 1 , 1987 . All development <br /> construction, reconstruction, moving, remodeling, or other <br /> structural alteration shall be made in conformity with the <br /> approved site plan. Any variation from the site plan shall <br /> be first approved by the Planning Division or Planning <br /> Commission. <br /> 3 . This Use Permit shall lapse and become void after eighteen <br /> ( 18 ) months unless prior to the expiration of eighteen ( 18 ) <br /> months a Building Permit is issued by the Building Inspection <br /> Division and construction, pursuant to the Building Permit , <br /> is commenced and diligently pursued toward the completion on <br /> the site. In addition, this Use Permit shall be null and <br /> void if the use( s) permitted are abandoned or unused for one <br /> year . <br /> 4. Any construction, reconstruction, moving, remodeling, or <br /> other alterations authorized by this Use Permit shall not be <br /> commenced or completed until all permits required by other <br /> departments or agencies have been secured. <br /> � 5 . In order to properly monitor the operation according to State <br /> Law, to ensure that it remains a viable tire recycling opera- <br /> tion and does not become an illegal landfill , the following <br /> conditions will be required: <br /> a. A quarterly inventory report is to be submitted to the <br /> Health District on the 30th day of January, April , July, <br /> and October of each year . The inventory report is to <br /> include : <br /> ( 1 ) Total tons of tires received at the site . <br /> ( 2 ) Total tons of tires shipped out whole from the site . <br /> Modified Conditions - 1 - (UP-83-69 ) <br />
