Analysis of Potential Impacts: <br /> Describe to what extent project activities would: <br /> a. Conflict with any applicable land use plan, policy, or regulation of an agency with <br /> jurisdiction over the project(including, but not limited to the general plan, specific plan, <br /> local coastal program, or zoning ordinance)adopted for the purpose of avoiding or <br /> mitigating an environmental effect. <br /> The Office of Mine Reclamation (OMR)was contacted to determine if any of the past <br /> owners had obtained permits to mine the subject property. The OMR was created in 1991 <br /> to administer the Surface Mining and Reclamation Act of 1975 (SMARA). Established to <br /> meet the Act's requirement, OMR minimizes the adverse environmental effects of mining <br /> by providing assistance to lead agencies and miners in the review of reclamation plans, <br /> and minimizes residual hazards to public health and safety through the Abandoned Mine <br /> Lands program. <br /> The OMR conducted several database searches for surface mine permits in San Joaquin <br /> County. The database searches were conducted for ownership of the subject property <br /> that began after 1975, when SMARA was enacted.According to the OMR, no surface <br /> mining permits or reclamation plans were located for property or property owners (Pereira <br /> Brothers, Inc., John and Marie Mercer/Eberhard and Rosemarie Schommarz, <br /> SCHOMERC, Inc., or Silas F. Royster). LFR contacted a Senior Planner at San Joaquin <br /> County to inform them of the upcoming project activities and to confirm their interest in <br /> site restoration (Van Buren 2003). The county was informed that this is an interim <br /> remedial activity and that any site restoration issues will be addressed after the <br /> comprehensive RI/FS is completed. The county concurred that they will review and <br /> provide input on any reclamation issues prior to the final disposition of the site. <br /> No Impact. The proposed project is excavation and removal of contaminated soils within <br /> an existing mining and industrial area. No division of a community would occur. All <br /> SMARA issues will be addressed in a Final RAP after the RI/FS is completed and prior to <br /> final disposition of the Site. <br /> b. Conflict with any applicable habitat conservation plan or natural community conservation <br /> plan. <br /> No Impact. There are no applicable habitat conservation plans or natural community <br /> conservation plans applicable to the project site(Funderberg 2003 and SJCG 2000). <br /> Findings of Significance: <br /> ❑ Potentially Significant Impact <br /> ❑ Potentially Significant Unless Mitigated <br /> ❑ Less Than Significant Impact <br /> X No Impact <br /> 10.
