LFR Levine-Fricke <br /> Response to Comments <br /> Remedial Action Plan for Pyrolytic Oil-and Metals-Affected Soil <br /> at the Tracy Tire Fire Site <br /> The State Clearinghouse distributed the Negative Declaration and Initial Study to state <br /> agencies: There were no comments from state agencies. The State Clearinghouse has <br /> certified that the Department of Toxic Substances Control (DTSC)has complied with <br /> review requirements for the draft environmental document pursuant to the California <br /> Environmental Quality Act (CEQA). <br /> Comments from and Responses to the San Joaquin County Public Works Department: <br /> 1. Comment: Page 43, Section 15, Transportation and Traffic, Subsections a-f: <br /> Your study needs to address the potential damage to the haul route road surface from the <br /> trucks as well as the size of the trucks and the number of axles. <br /> Response: The proposed haul route road is currently used by heavy trucks hauling materials <br /> for the nearby local mining and industrial facilities. The proposed trucks are three axle-trucks <br /> that will be towing two-axle, 40-cubic yard trailers. The vehicles proposed for the remediation <br /> activities at the Tracy Tire Fire Site are anticipated to cause a less than significant impact to <br /> the County designated haul route. A transportation plan will be submitted to San Joaquin <br /> County by the contractor before hauling begins. <br /> 2. Comment: Page 25, Section 5, Cultural Resources, Subsection(a), paragraph 1: <br /> While "no resources within the project area that are known to have value to local cultural <br /> groups have been reported to the CCIC" there is no indication that local Native American <br /> tribal representatives were directly notified of the proposed project. <br /> Response: The project consultant, Levine-Fricke(LFR)contacted the Native American <br /> Heritage Commission(NAHC)on September 3, 2003. The NAHC was provided with a project <br /> description and contact information regarding the proposed Tracy Tire Fire Site remediation <br /> activities. LFR, the Department of Toxic Substances Control (DTSC), and the California <br /> Integrated Waste Management Board(CIWMB) will coordinate with the NAHC and other <br /> Native American representatives as necessary. As previously described, the project site is an <br /> excavated gravel pit. Historic resources are not expected to be present. <br /> 3. Comment: Page 25, Section 5, Cultural Resources, Subsection(a), paragraph 2: <br /> Provide supporting reason(s)n as to why "a survey for historic resources recommended by the <br /> CCIC would not result in the identification of any resources" as concluded by Mr. John <br /> Holson of Pacific Legacy Incorporated. <br /> Final_RAP_Tracy_9.18.03(fina1).doc:LFR Page H-1 <br />
