Archbold, Esq.
NEUMILLER & BEARDSLEE
509 West Weber Avenue, 5th Floor
Stockton, CA 95203
RE: Roek Brothers Site
Our Client: Ted and Dena Knowles
Dear Mr. Archbold:
David Isola of our office has written you at least four times
and has made at least a dozen of telephone calls to your office for
the last several months. The only response we have had to date is
a phone message on our after-hours answering machine about a family
tragedy which we were very sorry to hear this news.
Our clients are totally frustrated with this matter. If we
could receive a phone call in response to our request for a
meeting, we may be able to resolve all the issues between our
respective clients. It is my belief that a meeting will be very
productive. Without cooperation between our clients, attorney's
fees will continue to be wasted on useless wrangling over issues
which do not address the overall problems.
By now you have received a copy of the letter directed to our
clients from Linda Turkette, of the San Joaquin County
Environmental Health Department dated June 6, 1994 . We cannot
respond to her letter without discussing with you and your clients
the work plan previously submitted by your clients and subsequently
rejected by the county. She has informed us that if the deadline
of July 8, 1994 is not met, the State of California will issue a
Cleanup and Abatement Order making the site inelligible for the
Underground Storage Tank Cleanup Fund Program.
This would be an extremely costly and expensive error. We
would hold your clients personally responsible if in fact this site
becomes inelligible for the Tank Fund because we cannot obtain the
necessary permission and cooperation to submit the work plan in a
timely manner. I urge you to respond to the concerns expressed in
this letter immediately.
