Wilson Way, Stockton <br /> San Joaquin County Public Health Services, Environmental Health Division CPHS/EHD) has received the <br /> letter from your office requesting more information on additional responsible party identification. <br /> The California State Water Resources Control Board has delegated the authority for the oversight of <br /> assessment and cleanup at contaminated underground storage tank sites CUST) to the local agencies with <br /> the creation of the Local UST Oversight Program. When a site is placed in the Local Oversight Program a <br /> search is conducted to list all appropriate responsible parties. Responsible parties are identified using <br /> applicable State Board definitions as well as using the Federal Resources and Conservation Recovery Act <br /> (RCRA) responsible party definition, if the program is funded by the Federal Petroleum Trust Fund, as is the <br /> case with this program. <br /> The definition of a responsible parry includes: <br /> 1) Any person who owns or operates an UST used to store petroleum. <br /> 2) For USTs no longer in use, the current owner of the UST. <br /> 3) Anyone who owned or operated the UST immediately before discontinuation of its use. <br /> 4) Any owner of property where an unauthorized release of petroleum from an UST has <br /> occurred. <br /> 5) Any person who had or has control over an UST at the time of or following an unauthorized <br /> release of petroleum. <br /> In addition, the RCRA responsible party definition includes: <br /> 1) For USTs brought into use before and after November 8, 1984, any person who owns the <br /> UST. <br /> 2) For USTs no longer in use on November 8, 1984, anyone who owned the UST immediately <br /> before the discontinuation of its use. <br /> A Division of fan Joaquin County Hcalth fIIe 4mcr C j <br />
