Box 944212 <br /> Sacramento, CA 94244-2120 <br /> Subject: 3245 North Wilson Way, Stockton, California <br /> Dear Mr. Lockwood: - <br /> In reference to our telephone conversation on the morning of 17 August 1995, concerning the <br /> reimbursement of funds for the subject property, I have the following comments: <br /> 1) Hydrocarbon impacted soil was excavated from the subject property in 1994 and stockpiled <br /> at a"storage"facility in Riverbank. Geological Audit Services, Inc. (GAS) provided technical <br /> supervision for the project and Bob Evans Trucking(BET) provided excavation and trucking <br /> services. GAS and BET were both contracted directly by Mr. Don Morris. Prior to <br /> excavation, a work plan was prepared by GAS and approved by the San Joaquin County <br /> Public Health Department -Environmental Health Division(PHS-EHD). The entire project <br /> proceeded at an accelerated pace to accommodate an impending bank loan by Mr. Morris. <br /> Upon final sampling, a closure letter was received from the PHS-EHD. <br /> 2) At the time of excavation, it was decided that the gasoline-contaminated soil could be easily <br /> treated via bioremediation at the Riverbank site for a significant cost savings as compared to <br /> landfill disposal. Data obtained prior to excavation indicated that the soil contained <br /> hydrocarbons at concentrations as high as 1,700 parts per million(ppm). <br /> 3) GAS and BET provided Mr. Morris with preliminary estimates comparing costs for the two <br /> options. However, due to the insufficient financial resources of Mr. Morris, remediation was <br /> postponed. <br /> 4) It is our understanding that Mr. Morris did not receive his Letter of Commitment(LOC) until <br /> December 1994. Therefore, it was impossible for Mr.Morris to negotiate disposal of the soil <br /> or obtain a bank loan against the LOC prior to actually receiving the LOC. As it was, both <br /> GAS and BET waited 11 months for payment. Once the LOC was obtained, Mr. Moms <br /> submitted his reimbursement request and payment-was subsequently received in March 1995. <br /> 1803 West March Lane, Suite A.
