Therefore,the City will apply <br /> to USACE for a Section 10 permit under the Rivers and Harbors Act <br /> to obtain permission to pass under the French Camp Outlet Canal and <br /> its tributary.Where construction activities would occur within 25 feet <br /> of the French Camp Outlet Canal or its tributaries or other areas with <br /> ^' freshwater marsh,biological monitoring will be conducted to ensure <br /> CD that there are no adverse effects on these sensitive habitats. <br /> A determination of waters of the United States,including wetlands <br /> and riparian habitat that would be affected by construction of the <br /> effluent outfall structure,would be made by qualified biologists <br /> through the formal Section 404 wetland delineation process.If <br /> CD <br /> necessary,the City will consult with the appropriate agencies(e.g., <br /> USAGE,DFG,and the U.S.Environmental Protection Agency),and <br /> p authorization for fill of jurisdictional areas will be secured from <br /> v USACE via the Section 404 permitting process and other applicable <br /> Q resource agencies'permitting processes,if required.As part of these <br /> o processes,measures will be developed to minimize impacts,such as <br /> CD conducting activities during the low-flow season and erecting <br /> o protective fencing to minimize the area of impact and potential for <br /> C runoff and siltation.Any jurisdictional habitat that is removed will be <br /> replaced or rehabilitated on a"no-net-loss"basis in accordance with <br /> applicable agency regulations and at a location and by methods <br /> agreeable to the applicable agencies.In addition,construction of the <br /> effluent outfall structure may require an encroachment permit from <br /> v the State Reclamation Board.Therefore,the City will consult with <br /> the Reclamation Board before initiating any construction activities. <br /> Cn <br /> M m <br /> v �u <br /> LTS=Less than Significant S=Significant PS=Potentially Significant SU=Significant and Unavoidable <br />
