SAN J O A R U N Environmental Health Department <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> AMERICAN CONTAINER INC 813 LUCE AVE, STOCKTON July 24, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br /> OBSERVATION: This business has an inactive hazardous waste ID number in the California Department of Toxic <br /> Substances Control (DTSC)database. The inactive number is CAL000421878. <br /> REGULATION GUIDANCE: A hazardous waste generator shall not treat, store,dispose of, transport or offer for <br /> transportation, hazardous waste without having received an Environmental Protection Agency(EPA)Identification <br /> (ID) Number.A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br /> month, less than 1 kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to reactivate your ID number. Immediately reactivate your ID number and submit evidence to the San Joaquin <br /> County Environmental Health Department within 30 days. <br /> This is a minor violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: The facility generates a solid sludge from a waste water treatment system. Waste water from <br /> the manufacturing of cardboard boxes with inks and adhesives is processed for discharge to the City of Stockton <br /> sewer system. A solid sludge generated by this process is collected and disposed of by the facility trash service. <br /> The facility does not have hazardous waste determination documentation to demonstrate that the solid sludge is <br /> being disposed of in accordance with Title 22 California Code of Regulations and California Health&Safety Code. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the solid sludge, and manage it <br /> according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to <br /> support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR <br /> including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
