OBSERVATION: A hazardous waste determination has not been made on the following possible hazardous waste: 1. Next to the hazardous waste storage area, spillage of what appeared to be two different types of soaps/cleaners was observed inside a red container storing two bottles of Dove Body Wash, one bottle of Raw Sugar Simply Hand Wash, and four bath sponges.According to Scott Barnett,the store manager,the spillage has been in the container since Tuesday, 7/14/20. 2. Next to the hazardous waste storage area, Bronkaid Ephedrine Sulfate caplets with expiration date 10/2020 were observed inside a container labeled as"RC Claims Only,""All items must be scanned out Thursday PM for Friday Pickup,"and "No go backs, unsellable, callins or recalls."According to Scott,the items in the RC Claims container are going to be sent to back to the Walgreens DC. However, Scott previously indicated that over the counter pharmaceuticals with an expiration date within the next three months are to be managed as hazardous waste. 3. The following damaged and/or expired items were observed in open unlabeled containers on a shelf above the hazardous waste storage area: -Studio 35 Beauty Daily Clarifying Face Daily Moisturizer expired in 12/2017. -Five leaky bottles of Nice! Mold& Mildew Remover containing bleach, and a fourth bottle of the Nice! bleach cleaner bagged with used absorbent. -At least seven boxes of Bayer aspirin chewable tablets, at least one of which expired in 07/2020. -Dr. King's AsthmaCare homeopathic medicine expired in 06/2020. -A damaged box of Bacitraycin ointment expired in 03/2020 and which appeared to have been leaked on by the Nice! bleach cleaner. -Five boxes of Optical 20/20 Eye Redness Reliever and Lubricant expired in 01/2019. -Nine containers of Zim's Max Freeze Lidocain and Menthol Pain Relief Patches, at least three of which were expired in 03/2019. -Two damaged boxes of TRP Stye Relief and two damaged boxes of TRP PinkEye Relief, all of which appeared to have been leaked on by the Nice! bleach cleaner. According to Scott, these items are"Pull and Quarantine"items,which were removed from the sales floor until the facility receives a disposition for the items. It was unclear how long ago these items were pulled from the sales floor, but Scott indicated that the items have been quarantined for a long time. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive or ignitable. CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste , and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status.
