SAN J D AR I N Environmental Health Department <br /> I Y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> BERNARD A WEVER TRUCKING 777 S LOCUST AVE, RIPON JUly 27, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: The following were observed outside in the diesel tank area: <br /> -One 55-gallon drum with unknown contents observed in the secondary containment of the 9,000 gallon diesel tank. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for the 55-gallon drum with unknown <br /> contents, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste sampling and test results <br /> or other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br /> specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a repeat violation, Class Il. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The following were observed near the aboveground diesel tank area: <br /> -One leaking fuel nozzle connected to the 9,000-gallon diesel tank, observed actively leaking diesel into one <br /> 5-gallon bucket. Diesel stain observed accumulating inside secondary containment and outside of secondary <br /> containment. <br /> -One diesel stain observed underneath diesel pump dispenser. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean diesel stains in and out of secondary containment for the 9000-gallon <br /> diesel tank and fix leaking diesel fuel nozzle. Manage the waste according to Title 22 California Code of Regulations <br /> for hazardous waste.
