ID <br /> numbers are unique to a business and site location. <br /> CORRECTIVE ACTION: Go to the DTSC web site at hftps://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br /> to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County <br /> Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATION 1:The manager, Roberto Rojas,explained that he hires people to dispose of used antifreeze and <br /> non-crushed/punctured used oil filters. The people take the waste and do not leave any documentation showing <br /> how the waste is disposed of or where it is taken to. <br /> OBSERVATION 2: Robert Rojas stated that he takes oily absorbent to the dump for disposal. <br /> OBSERVATION 3: Two old 1 gallon rusted paint cans were found underneath equipment near the shop entrance. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately cease disposal of the oily absorbent, used antifreeze, oil filters, and paint, <br /> make a hazardous waste determination for each waste, and manage them according to Title 22 CCR. Use Safety <br /> Data Sheets(SDS),waste sampling and test results or other knowledge to support your hazardous waste <br /> determination. Waste testing must be done using methods specified in Title 22 CCR including sections <br /> 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes.
