STOCKTON July 28, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS ll,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 104 CCR 66262.34(d)(2) No modified contingency plan. <br /> OBSERVATION: A complete modified contingency plan was not posted at the facility. <br /> REGULATION GUIDANCE: The business operator must post the following information next to telephones or in <br /> areas directly involved in the generation and accumulation of hazardous waste: the name and emergency <br /> telephone number of the emergency coordinator,the location of fire extinguishers and spill control material, and the <br /> telephone number of the fire department unless the facility has a direct alarm. <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by the owner, Isaura Corona, filling out a <br /> complete contingency plan. No further action is required to correct this violation. <br /> This is a Class II violation. <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br /> OBSERVATION: At the time of inspection, it could not be demonstrated(not necessarily documented)that <br /> employees who handle hazardous waste were properly trained. The manager, Roberto Rojas stated that the <br /> employees have not been given any hazardous waste training. <br /> REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper <br /> waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and <br /> emergencies. <br /> CORRECTIVE ACTION: Immediately train the employee. Provide proof of training within 30 days to the San <br /> Joaquin County Environmental Health Department(EHD)for employees whose responsibilities include hazardous <br /> waste. <br /> This is a Class II violation. <br /> 107 CCR 66262.20 Failed to prepare manifests for transportation of hazardous waste. <br /> OBSERVATION: The manager, Roberto Rojas, stated that he hires people to dispose of his used oil. No Uniform <br /> Hazardous Waste Manifest is filled out when the people Roberto hires picks up the used oil. <br /> REGULATION GUIDANCE: A hazardous waste generator who transports, or offers for transport a hazardous <br /> waste for off-site transfer,treatment, storage, or disposal shall prepare a Uniform Hazardous Waste Manifest(OMB <br /> Control number 2050-0039)on EPA Form 8700-22, and, if necessary, a Continuation Sheet on EPA Form 8700- <br /> 22A, according to the instructions included in the Appendix to chapter 12 of this division before the waste is <br /> transported off-site. <br /> CORRECTIVE ACTION: When required by California Health&Safety Code and Title 22 California Code of <br /> Regulations, ensure that an Uniform Hazardous Waste Manifest is prepared each time to transport hazardous <br /> waste from this facility for off-site transfer,treatment, storage or disposal.
