The statewide Unified Program regulations eliminated the offset of BOE <br /> fees by nullifying the State Department of Toxic Substances Control (DISC) agreements with local <br /> agencies referenced in the Revenue and Taxation Code. A final determination on whether this benefit to <br /> businesses would be re-authorized was not known until passage of SB 660 (The Environmental Cleanup <br /> and Fee Reform Act of 1997) which was signed by Governor Wilson in October 1997. The final version of <br /> the SB 660 does not reinstate the offset. but does provide for a possible refund of hazardous waste <br /> disposal fees collected by the BOE for 1997,if the following conditions are met: <br /> • DTSC determines that there are sufficientfunds available for the refund which will not occur before <br /> February 1998; <br /> and <br /> • A business received an offsetof BOB fees for hazardous waste generated in 1996 <br /> • The amount of the refund cannot exceed either the smaller of the amount of the offset received for <br /> 1996 orthe amount of hazardous waste generator fees paid to a local agency in 1997. <br /> Therefore, the EHD Hazardous Waste Generator Permit Fees must be paid by December 31, <br /> 1997, in order to maintain eligibility for any refund of BOE fees. <br /> Revision of the EHD Hazardous Waste Generator Program Fees <br /> The EHD will proceed with revision of the Hazardous Waste Generator Program fees to reflect the actual <br /> program cost in each fee category after industry workshops and meetings with the affected businesses. <br /> Timing of the presentation of the revised fee proposal to the Board of Supervisors for public hearing and <br /> adoption will be dependent on whether the refund of BOE fees is authorized. <br /> It is the intention of the EHD to propose the following to the Board of Supervisors. <br /> ♦ If the refund of BOE fees does occur <br /> • A revised fee schedule will be presented to the Board of Supervisors in June at the final FY 1998-99 budget <br /> hearings and will go into effect on August 1, 1998. <br /> • The revised fees would be billed during the normal 1998-99 permit billing cycle. <br /> ♦ If the refund of BOE Fees does not occur <br /> • A revised fee proposal will be presented to the Board of Supervisors immediately after the workshops and <br /> become effective 30 days after adoption. <br /> The facilities that were charged a fee in 1997 that was lower than the revised fee would be billed for the <br /> difference <br /> • Those facilities that were charged a higher fee than the revised fee would receive reimbursement of the <br /> difference from the EHD. <br /> °"Conditionally Exempt"tier category.
