Any materials collected arc <br /> then handled as a hazardous waste in accordance with all applicable requirements. <br /> (e) The owner or operator shall submit to the Department with the application for a hazardous waste <br /> facility permit a written statement signed br cin independent, yualffied pro%ssional engineer, registered <br /> in Califurnia, that indicates that the cuntainment system is suitably designed to achieve the requirements <br /> of this section. <br /> This letter addresses this requirement. <br /> (d) Storage areas that store containers holding only hazardous wastes that do not contain free liquids <br /> need nut helve a containment system as specified by subsection (b) of this section, except as pruvieled by <br /> subsection (e) of this section or provided that: <br /> (1) The storage area is sloped or is otherwise designed and operated to collect and remove liquid <br /> resullingfruin precipitation, or <br /> (2) The containers are elevated or are othenrise prolectedfrum contact with accumulated liquid. <br /> (e) Storage areas that.store containers holding the,iillowing wastes listed that do not contain free <br /> liquids must have a contuinmenl system as specified by subsection (h) of this section: F010, F021, F022, <br /> F023, F026, and F027, <br /> The containers to he protected hold free liquids; therefore these items do not apply. <br /> CONCLUSION <br /> Rased on the information provided to me by OMI as reviewed above, I professionally certify that the <br /> proposed secondary containment device for the'1"I'U is suitably designed to achieve the requirements of <br /> CCR Title 22 Section 66264.175. <br /> OROf ESS/pN <br /> John M.
