S A NJ O A Q U IN Environmental Health Department <br /> COUNTY ---- <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> Smart Final#393 744 W Hammer Ln, Stockton November 04, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 103 CCR 66262.40(c) Failed to retain hazardous waste determination including waste analysis on site for 3 years. <br /> OBSERVATION: The waste listed below was found bagged and inside the Aerosols, Flammables and <br /> Combustibles(AF)Hazardous Waste tote in the hazardous waste storage area(see photos IMG 9241-9242). <br /> When Josie Bautista, Receiver, scanned the barcodes on the following waste,the hand-held scanner stated <br /> "AF-Red,"indicating the waste should be placed into AF Hazardous Waste tote: <br /> -Two aerosol cans of Professional Easy-Off Oven Cleaner, labeled with"Caution: Eye irritant. Contains <br /> Monoethanolamine and Diethylene Glycol n-Butyl Ether"(IMG 9243-9). <br /> -An aerosol can of Lysol Disinfectant Spray, labeled with"Caution: Causes moderate eye irritation"(IMG 9250-4). <br /> -Eight aerosol cans of First Street Butane Fuel, labeled with"Danger: Extremely Flammable Gas." <br /> -An aerosol can of food oil spray. <br /> -An aerosl can of Cake Icing. <br /> It is unknown if the Professional Easy-Off Oven Cleaner and the Lysol Disinfectant Spray are compatible with <br /> flammable hazardous waste. <br /> The business operator does not have hazardous waste determination records that support the current handling <br /> and disposal of the waste. <br /> REGULATION GUIDANCE: A business operator shall keep records of any hazardous waste determinations made <br /> in accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the <br /> date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may <br /> include Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the waste Professional <br /> Easy-Off Oven Cleaner,waste Lysol Disinfectant Spray, and any other potentially incompatible hazardous waste, <br /> maintain on site and submit a copy to the San Joaquin County Environmental Health Department(EHD). <br /> If hazardous waste determination documentation is not available, immediately make a hazardous waste <br /> determination and begin managing the waste Professional Easy-Off Oven Cleaner,waste Lysol Disinfectant Spray, <br /> and any other potentially incompatible hazardous waste as specified in Title 22 CCR. Use Safety Data Sheets <br /> (SDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste <br /> testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a <br /> statement and supporting documentation with your hazardous waste determination. <br /> Demonstrate current storage and labeling for wastes determined to be hazardous wastes.
