Any person who generates a waste shall determine if the waste <br />is a hazardous waste. Immediately stop throwing away metal fines in the garbage, make a hazardous waste <br />determination for the brake shavings , and manage it according to Title 22 hazardous waste regulations. Particles <br />100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. <br />Submit a statement and supporting documentation explaining how this waste was managed. <br />Note: One white plastic 5 gallon bucket was observed near the brake shaving equipment with a hazardous waste <br />label. On 12/28/2017 brake shavings were disposed of as hazardous waste on manifest # 016698077JJK. <br />This is a minor violation. <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br />Manifest numbers 019742646JJK (1/2/19), 019015963JJK (6/28/18), 018412765JJK (2/2/18) were found without a <br />signed off copy from the destination facility. Manifest numbers 017468456JJK (8/1/17), 018042164JJK (11/13/17), <br />016698077JJK (12/28/17), were missing from the generator records. Hazardous waste generators shall retain <br />copies of all manifests signed off by the destination facility on site for three years and have them readily available for <br />review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or <br />operator of the facility to which the generator’s waste was submitted within 60 days of the date the waste was <br />accepted by the initial transporter, the generator shall submit a legible copy of the missing manifest, with some <br />indication that the generator has not received confirmation of delivery. This information shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br />Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. <br />Submit to the EHD a copy of the signed off copy of the manifest or a copy of the information submitted to DTSC. <br />This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br />Copies of hazardous waste disposal records for used antifreeze for 2018 were not found on site. Hazardous waste <br />generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a <br />consolidated manifesting procedure on site for three years and have them readily available for review.
