Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />May 03, 2019 <br /> Facility Address: <br /> 3538 Manthey Rd, Stockton <br /> Facility Name: <br /> Dollar Tree #05525 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br />Based on the types of violations observed, the facility employees are not trained on proper hazardous waste (HW) <br />handling or the training provided has been inadequate. <br />- A State-Regulated, Toxics, OTC Pharmaceuticals, and Universal (STOU) HW tote marked with an accumulation start <br />date of 3/11/19 and liquid as the physical state was found containing the following bagged items (IMG 5743): <br /> - An open empty 6.5 fl. oz. container of Bolero Nourishing Body Polish, along with used paper towels. When asked <br />what happened to the liquid that was once contained in the container, Marlene Ibardolaza, store manager, said she did <br />not know, but that the item may have spilled in the truck when it was shipped to the store. The amount of used paper <br />towels found in the bag did not account for the amount of liquid missing from the container (see photo IMG 5744-5). <br /> - Four boxes of solid birthday candles (IMG 5746). <br />- A STOU HW tote marked with an accumulation start date of 1/14/19 and liquid as the physical state was found <br />containing the following bagged items (IMG 5747): <br /> - An empty 35 fl. oz. container of Final Touch fabric softener. Used absorbent was not found to account for the <br />missing liquid from the container. Marlene did not know what happened to the missing liquid. (IMG 5748) <br /> - An empty container of Silkience Salon Series Hydrating Shampoo and an empty container of Alberto VO5 3-in-1 <br />body wash, shampoo, and conditioner formula were found bagged together with used paper towels. The amount of <br />used paper towels in the bag did not account for the amount of liquid missing from each container. Marlene did not <br />know what happened to the liquids. Also, when the VO5 3-in-1 formula was scanned by Marlene, the hand held <br />scanner stated the item was "Not Hazardous." (IMG 5749-52) <br /> - A half-filled 16 oz. container of Xcess Styling Gel. Used absorbent was not found to account for the missing gel that <br />was once in the container. Marlene did not know what happened to the missing gel that was once in the container. <br />(IMG 5753-4) <br /> - An open empty 15 fl. oz. container of Alberto VO5 New Extra Body With Collagen Volumizing Shampoo. Used <br />absorbent was not found to account for the missing liquid from the container. Marlene did not know what happened to <br />the missing liquid. (IMG 5755) <br /> - An empty 32 fl. oz. container of The Home Store All-Purpose Cleaner with Bleach. Used absorbent was not found <br />to account for the missing liquid that was once in the container. Marlene did not know what happened to the missing <br />liquid, but said that the item may have been a "store-use item" used to cleaned the facility. When asked how <br />employees differentiate between a "store-use" item vs a non- "store use" item, Marlene stated a sticker is placed on <br />the barcode when the item is removed from the facility's inventory. The empty container of The Home Store <br />All-Purpose Cleaner with Bleach did not have a sticker on the barcode, nor any other indication that it was a <br />"store-use" item. (IMG 5756-8) <br /> - When the empty container of The Home Store All-Purpose Cleaner with Bleach was scanned by Marlene, the <br />hand-held scanner stated the item should be placed in an STOU HW tote (IMG 5759). Although, according to the <br />Dollar Tree Potentially Hazardous Material Management poster posted adjacent the HW storage area, item labels with <br />keywords such as "Bleach" are classified as Oxidizers (OX) (IMG 5822, 5863). <br /> - A 4 fl. oz. container with approximately 1 fl. oz. left of Assured Regular Strength Stomach Relief Bismuth <br />subsalicylate 525 mg. Used absorbent was not found to account for the missing liquid that was once in the container. <br />Marlene said she did not know what happened to the missing liquid, but guessed that a customer opened the <br />package, drank some of the medicine in the store, and left the remaining liquid in the container. (IMG 5760-2) <br /> - An open empty container of Mod Podge with hardened leakage on the outside of the container. Used absorbent <br />was not found to account for the missing liquid that was once in the container. Marlene did not know what happened <br />to the missing liquid.
