Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />October 10, 2019 <br /> Facility Address: <br /> 2073 E Yosemite Ave, Manteca <br /> Facility Name: <br /> Morgan Automotive Repair <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br />OBSERVATION: Designated facility signed copies of Uniform Hazardous Waste Manifest (UHWM) numbers <br />020383198JJK dated 7/25/19, 017696699JJK dated 7/18/18, and 017791731JJK dated 8/18/17 were not found <br />on-site. <br />REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br />with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility <br />which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br />waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest <br />to the California Department of Toxic Substances Control (DTSC) within 60 days if the destination facility signed <br />manifest copy is not received from the transporter or designated facility. <br />CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br />Joaquin County Environmental Health Department (EHD). If the destination facility signed manifests cannot be <br />found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility <br />signed copy was not received by the generator. DTSC address is DTSC Report Repository, Generator Information <br />Services Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD <br />within 30 days. <br />This is a Class II violation. <br /> 111 CCR 66262.42(a)(c)(d) Failed to comply with uniform hazardous waste manifest exception requirements. <br />OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests <br />(UHWM) numbers 020383198JJK dated 7/25/19, 017696699JJK dated 7/18/18, and 017791731JJK dated 8/18/17 <br />REGULATION GUIDANCE: <br />(a) A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator <br />of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the <br />transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. <br />(c) A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the <br />owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the <br />hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the <br />manifest, with some indication that the generator has not received confirmation of delivery. <br />(d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information <br />Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br />CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San <br />Joaquin County Environmental Health Department (EHD).
