In the <br />hazardous waste storage area, used oil was observed in secondary containment underneath a red 55 gallon steel <br />drum. According to Peter Vacco, Technician, the drum was rusted on the bottom and leaking oil. <br />REGULATION GUIDANCE: Hazardous waste shall be stored in a containers that are in good condition. If a <br />container holding hazardous waste is not in good condition (e.g., severe rusting, apparent structural defects), or if it <br />begins to leak, the owner or operator shall transfer the hazardous waste from this container to a container that is in <br />good condition, or manage the waste in some other way that complies with the hazardous waste requirements. <br />CORRECTIVE ACTION: Immediately transfer the used oil into a container that is in good condition. Provide a <br />corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br />This is a Class II violation. <br />403 <br />CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />OBSERVATION: The following open hazardous waste storage container was observed on-site: one 3 gallon drain <br />pain containing used oil (1/3 full) and one metal used oil filter. <br />REGULATION GUIDANCE: A container holding hazardous waste shall always be closed during transfer and <br />storage, except when it is necessary to add or remove waste. <br />CORRECTIVE ACTION: Immediately close the container and ensure all hazardous waste containers are closed <br />when not adding or removing waste.
