STOCKTON <br />October 11, 2019 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />202 <br />HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. <br />OBSERVATION: Peter Vacco, Technician, drains used metal oil filters by puncturing and crushing them. After the <br />filters have been drained, they are disposed of into the trash. <br />REGULATION GUIDANCE: The disposal of any hazardous waste, or the causing thereof, is prohibited when the <br />disposal is at a facility which does not have a permit from the department issued pursuant to this chapter, or at any <br />point which is not authorized according to this chapter. Hazardous wastes shall be disposed of only by <br />transportation to a permitted hazardous waste treatment, storage, and disposal facility (TSDF) or other authorized <br />point. <br />CORRECTIVE ACTION: Immediately cease disposal of used oil filters into the trash. Provide a corrective action <br />statement to the San Joaquin County Environmental Health Department within 30 days. <br />This is a Class I violation. <br />303 <br />CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />OBSERVATION: In the hazardous waste storage area, used oil was observed in a secondary containment <br />underneath a red 55 gallon steel drum that was containing used oil. According to Peter Vacco, Technician, the <br />drum was rusted on the bottom and leaking oil. Used oil was also observed in another secondary containment that <br />was holding a black 55 gallon steel drum containing used oil. <br />REGULATION GUIDANCE: All facility communications or alarm systems, fire protection equipment, spill control <br />equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure <br />its proper operation in time of emergency. <br />CORRECTIVE ACTION: Immediately drain the secondary containment and start to properly manage the secondary <br />containment.
