Environmental Health Department <br />Small Quantity Hazardous Waste Generator Inspection Report <br />Date: <br />December 05, 2019 <br /> Facility Address: <br /> 1003 HUMPHREYS DR, STOCKTON <br /> Facility Name: <br /> ONION ETC INC <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 101 CCR 66262.12 Managed a hazardous waste without an identification number. <br />OBSERVATION: This business does not have a permanent hazardous waste ID number in the California <br />Department of Toxic Substances Control (DTSC) database. <br />REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for <br />transportation, hazardous waste without having received an Environmental Protection Agency (EPA) Identification <br />(ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per <br />month, less than one kg of acutely hazardous waste per month or any amount of non-RCRA hazardous waste. ID <br />numbers are unique to a business and site location. <br />CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa-id-number/ <br />to obtain a permanent State ID number since the facility has ongoing hazardous waste generation and storage. <br />Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health <br />Department within 30 days. <br />This is a minor violation. <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br />OBSERVATIONS: The facility uses rags for oil cleanup and the oily rags go into the regular trash when they can no <br />longer be used. Approximately 10 waste lamp ballasts were observed in the northeast corner of the facility. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br />as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous <br />wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive <br />or ignitable. <br />CORRECTIVE ACTION: Immediately stop disposing of oily rags in the regular trash, make a hazardous waste <br />determination for the oily rags and the lamp ballasts, and manage it according to Title 22 CCR. Use Safety Data <br />Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. <br />Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes.
