1 demolition waste (C&D) per San Joaquin County Ordinance Code, Chapter 3, <br /> 2 Section 5-2302 and the waste generated by their own company. Robert McClellon <br /> 3 cautioned him that if the EHD receives a complaint regarding one of his <br /> 4 dumpsters, that the EHD will follow up and determine if the dumpster is in <br /> 5 violation. Robert McClellon explained that the EHD will survey the dumpster <br /> 6 and determine if the waste is C&D or other waste. Robert McClellon explained <br /> 7 that cleaning up around a property is not considered C&D. Mr. Stuit <br /> 8 indicated that he understood and indicated that they would be pursuing C&D <br /> 9 waste type until they get their haulers license, if they decide to apply. <br /> 10 <br /> 11 On April 23, 2003, the EHD received a fax message from the complainant <br /> 12 (See Exhibit F) . The fax message indicated several locations where Roos <br /> 13 Ranches had garbage bins. Robert McClellon directed Ted Tasiopoulos to make <br /> 14 inspection to verify the information. Ted Tasiopoulos investigated and <br /> 15 discovered three other garbage bins at the locations in the area specified in <br /> 16 the fax, and documented the site where the bins were located (See Exhibit G) <br /> 17 During the investigation Ted Tasiopoulos also verified and documented that <br /> 18 the garbage bins discovered on April 16, 2003 where removed from Woodward <br /> 19 Avenue and South Highway 99 locations. <br /> 20 <br /> 21 On April 24, 2003, Robert McClellon received a phone call from Jeff <br /> 22 Stuit of Roos Ranches. He stated "Well, I see you are still pounding the <br /> 23 pavement over this one." Robert McClellon explained that Mr. Stuit was told <br /> 24 that if the EHD received a complaint that the EHD was going to follow up. <br /> 25 Robert McClellon explained that Mr. Stuit was told that the letter stated <br /> immediately discontinue the collection and transportation of solid waste.
