This e-mail correspondence is provided as attachment to this letter. The <br />following addresses the concerns identified by the SJC EHD and Public Works Department (PWD). <br />The email correspondence indicates that the SJCPWD has determined the Wastewater Holding Tank (Project) is <br />located within the floodway. The San Joaquin County Code Title 9 Section 9-110.4 defines a floodway as: <br />Floodway. "Floodway" means: <br />(1) the channel of a river or other watercourse and the adjacent land areas that must be reserved in order to <br />discharge the one -hundred (100) year flood without cumulatively increasing the water surface elevation <br />more than one (1) foot; <br />(2) the floodway shown on the Flood Insurance Maps; <br />(3) the designated floodway of the State Reclamation Board, if the Flood Insurance Maps do not indicate the <br />floodway; <br />(4) the river or other watercourse itself, between its levees or banks, to the elevation of the one -hundred <br />(100) year flood, if the Flood Insurance Maps do not indicate the floodway and the State Reclamation <br />Board has not established a designated floodway; or <br />(S) the channel necessary to carry a flood with a one percent (I %) or greater probability of occurring in any <br />given year established by the Floodplain 4dministrator, if the above criteria do not determine the <br />floodway. <br />In order to determine if the Project location is a floodway as defined by definition (2), KSN reviewed the effective <br />FEMA FIRM map for the project location. FEMA FIRM Panel 06077CO28OF with an effective date of October <br />16, 2009 does not show a floodway having been calculated or designated at the Project location (See Attached <br />FIRMette). The Project is located within a Zone AE (Static Elevation 9). A review of the effective Flood <br />Insurance Study (FIS) Report for San Joaquin County (06077CV00I13, 06077CV002B, & 06077CV003B) further <br />confirms that no floodway has been calculated or determined by FEMA for this project location. Furthermore, the <br />effective hydraulic model for this location is a hydro -dynamic model (DWR's Delta RMA2 hydro -dynamic <br />model). <br />In order to determine if the Project location falls within the definition of a floodway under item (3), KSN <br />reviewed the CVFPB's BAM Websitel, as to whether a Designated Floodway is shown at the project location.
