am not alive when the project closes out. Disturbingly, I see the equity being squandered away with out of
control contractors that spend my equity down with little benefit to the residents. Over $800,000 has been
spent over there, (including $200,000 I spent out of pocket to try and solve the problem before resorting to
going into the EAR Program) and there is little to show for it. Whatever work was really justified for adequate
protection I am fine paying for, but the work performed without adequate oversight and hence yielding little
benefit, should not be charged to me.
I have written you or copied you on many letters where I have identified work that should not have been
performed. I'm asking again that you audit all the work for appropriateness, remove the unjustified charges,
and impose a lien on the property, at the end of the project, for the corrected charges that should really be
there, per the original agreement so I can borrow the money against the equity and pay the lien.
Sincerely,
Frank Guinta
cc: Attorney James Struck, The Struck Firm, 125 McHenry Ave., Modesto 95354
Cori Condon, Jim Barton, Brian Newman, SWRCB, Sacramento
John Russell, Lilly Lee, Diana Romero, Pearl Cross, SWRCB UST Cleanup Fund, Sacramento
Nuel Henderson, San Joaquin Co.
