Collecting, Processing and Recycling UNIVERSAL WASTE
Are there any special requirements if I want to export my
Universal Waste?
Yes. Refer to 40 CFR 273.20 or your state regulations for more
information.
What if I want to accumulate my Universal Waste
on-site for more than one year?
In most(but not all) states, Universal Wastes may be accumulated
longer than one year if it can be demonstrated that it is being done to
"facilitate proper recovery, treatment or disposal". The burden of proof
is on the handler to prove that a longer accumulation time is necessary.
If a desire to pay lower recycling or disposal costs is the only reason for
longer accumulation, this may not meet this burden of proof.
My facility generates other hazardous waste in addition to
some Universal Wastes. Do I have to count my Universal
Wastes in determining my generator status as an LQG, SQG,
or VSQG?
No. Hazardous wastes managed as Universal Wastes do not have to
be counted when determining generator status.
My facility has to submit a SARA 313 Toxic Release Inventory
(TRI) report each year. Do I have to consider my Universal
Wastes sent offsite as a "release"?
Unbroken lamps, batteries and thermostats are usually considered
as "articles" and are therefore exempt from TRI reporting.
Leader Guide:eviscpruc_vod
