03:
GLASS
LIFE
2, Regulatory Framework - §112.1
The purpose of this SPCC Plan is to describe measures implemented by Owens-Brockway to
prevent oil discharges from occurring and to prepare Owens-Brockway to respond in a safe,
effective, and timely manner to mitigate the impacts of a discharge from the Facility.
This Plan has been prepared to meet the requirements of Title 40, Code of Federal Regulations,
Part 112 (40 CFR Part 112), and supersedes any previously drafted plans for this Facility. There is
a law, in the State of California, that applies to aboveground tanks that contain petroleum: the
California Aboveground Petroleum Storage Act(APSA) in the California Health and Safety Code
Section 25270 (H&SC 25270). The APSA requires that facilities complete a SPCC Plan per the 40
CFR 112 requirements, perform monitoring to detect releases, and pay biennial storage statement
fees to the State of California if the aboveground quantities of oil on-Site are in excess of the SPCC
Plan requirements in 40 CFR 112.
In addition to fulfilling requirements of 40 CFR 112, this SPCC Plan is used as a reference for oil
storage information and testing records, as a tool to communicate practices on preventing and
responding to discharges with employees, as a guide to Facility inspections, and as a resource
during emergency response. The information and guidelines held within, compile the safeguards,
inspections, and best practices to prevent a discharge to the environment before it happens.
3. If requested, the Plan will be available for on-Site review by
representatives of the EPA or other local regulatory entities during normal working hours. In
addition, copies of the Plan must be available for access to all persons responsible for
administration of the Plan.
4.
